Welcome to AISocialPilot. These Terms of Service ("Terms") govern your access to and use of the AISocialPilot platform, website, APIs, and related services (collectively, the "Service") operated by AISocialPilot ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Account Registration

To use AISocialPilot, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorized access or security breach.

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account. We reserve the right to suspend or terminate accounts that contain false or misleading information.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You shall not:

• Use the Service to send spam, unsolicited messages, or content that violates any applicable law.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses, malware, or other harmful code.
• Use automated tools to scrape, crawl, or extract data from the Service beyond what our APIs permit.
• Violate the terms of service of any third-party social media platform connected through the Service.

We reserve the right to suspend or terminate your account if you engage in prohibited conduct, with or without prior notice.

3. Subscription Plans and Billing

AISocialPilot offers several subscription plans with varying features and usage limits. By selecting a paid plan, you agree to the following:

• Recurring Charges: Subscription fees are billed on a recurring basis (monthly or annually) depending on the billing cycle you select. Your payment method will be charged automatically at each renewal.
• Free Trial: If a free trial is offered, you will not be charged until the trial period ends. You may cancel at any time during the trial to avoid charges.
• Price Changes: We may adjust pricing from time to time. We will provide at least 30 days' notice before any price increase takes effect on your account.
• Taxes: Prices are exclusive of applicable taxes, which will be added to your invoice as required by law.

All payments are processed securely through Stripe. We do not store your full credit card details on our servers.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation:

• Your access continues until the end of your current billing period.
• No prorated refunds are issued for unused portions of a billing cycle.
• Your data will be retained for 30 days after the end of your billing period, after which it may be permanently deleted.

Refund requests for exceptional circumstances may be submitted to our support team and will be evaluated on a case-by-case basis.

5. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is owned by AISocialPilot and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

You retain full ownership of the content you create and publish through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit Your Content solely for the purpose of operating and improving the Service. This license ends when you delete Your Content or close your account.

6. AI-Generated Content

AISocialPilot uses artificial intelligence to help you generate social media content, including post captions, hashtags, and suggestions. You acknowledge that:

• AI-generated content is provided as suggestions only. You are responsible for reviewing, editing, and approving all content before publishing.
• We do not guarantee the accuracy, originality, or suitability of AI-generated content for any particular purpose.
• You are solely responsible for ensuring that content published through your accounts complies with applicable laws and platform policies.

7. Data Handling and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the data practices described in our Privacy Policy, including the processing of data necessary to connect your social media accounts and deliver the Service.

8. Third-Party Integrations

The Service integrates with third-party social media platforms (such as Instagram, Twitter/X, LinkedIn, Facebook, TikTok, YouTube, and Pinterest) and other services (such as Stripe for payments). Your use of these integrations is subject to the respective third-party terms of service.

We are not responsible for the availability, accuracy, or practices of third-party platforms. Changes to third-party APIs or policies may affect the functionality of the Service, and we are not liable for any disruption caused by such changes.

9. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, deploy updates, or experience downtime due to circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• AISocialPilot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities.
• Our total aggregate liability arising from or related to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless AISocialPilot and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

• Violation of these Terms or any applicable law.
• Non-payment of subscription fees.
• Extended periods of account inactivity (12 months or more).
• Conduct that may harm AISocialPilot, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AISocialPilot operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law, in which case disputes shall be brought in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our practices, features, or legal requirements. When we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
